Terms of Service

1) Who We Are

These Terms of Service ("Terms") govern your access to and use of the Camp Trask website and related services (the "Service"). "We," "us," and "our" refer to Camp Trask, operated under the oversight of Greater LA Scouting (the "Council").

2) Scope and Audience

The Service exists to support Camp operations and program-related photo sharing. It is intended for camp staff, unit leaders, Scouts age 16 and older, and families. It is not a general social network or advertising platform. Accounts may not be created by or for anyone under age 16.

3) Accounts and Access

  • Authentication is provided by Clerk. By signing in, you also agree to Clerk's terms and policies. Clerk provides a built-in option to delete your account at any time.
  • No accounts may be created for users under age 16. Parents, guardians, and unit leaders may create accounts for themselves to manage photos, but not for minors.
  • We may suspend or terminate access at any time to protect users, uphold these Terms, or maintain the Service.

4) Photos and User Content

You retain ownership of photos and other content you submit ("Content"). By submitting Content, you grant Camp Trask a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, adapt (e.g., resize/crop/optimize), and distribute your Content solely for camp purposes, including program albums and internal communications. Any broader use (e.g., public marketing) will be sought under separate permission.

Camp staff may also upload photos from previous years. If your family, unit, or a Scout appears in those photos and you would like them removed, please email legal@camptrask.com. We will honor removal requests promptly.

Content Standards

  • No illegal, harassing, hateful, violent, or unsafe content.
  • No sexual content, nudity, or exploitation of minors.
  • No posting of sensitive personal data (e.g., home addresses, school or medical records).
  • No malware, spam, scraping, or attempts to impair the Service.
  • Only submit photos you have the right to share.

Note: Photos can contain embedded metadata (e.g., EXIF/GPS). We do not use such metadata for tracking and may remove or ignore it during processing; however, we do not guarantee removal. You can strip metadata before upload if desired.

5) Moderation and Takedown

Admins may review, approve, reject, remove, crop, or otherwise moderate Content at their discretion. If you believe Content should be removed, email legal@camptrask.com with a description and link. We will make a good-faith effort to review and respond within 10 business days.

6) Intellectual Property

  • Site materials (design, code, and camp graphics) are owned by Camp Trask or its licensors and protected by applicable IP laws. Except for your Content, you may not copy, distribute, or create derivative works without permission, other than as allowed by law.
  • Scouting names and marks are the property of their respective owners and used here for identification only.

7) Acceptable Use

  • Use the Service only for legitimate camp-related purposes.
  • Do not attempt to bypass security or access others' data.
  • Do not reverse engineer, scrape, or overload the Service.
  • Do not upload Content you do not have the right to share.
  • Do not use the Service for commercial purposes, including datasets, advertising, or resale.

8) Third-Party Services

We rely on service providers to operate this Service, such as: Clerk (authentication), Convex (database), Cloudflare R2 (storage), and hosting/CDN. Your use of Clerk is subject to Clerk's own terms and policies. We are not responsible for third-party services we do not control.

9) Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL EXPRESS OR IMPLIED WARRANTIES, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR AVAILABILITY. WE DO NOT PROMISE UNINTERRUPTED OR ERROR-FREE OPERATION.

Camp Trask may provide informational content (such as safety tips or program guidance). This content is for general information only and does not constitute safety, medical, or legal advice.

10) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CAMP TRASK, THE COUNCIL, AND STAFF WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, GOODWILL, OR PROFITS, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE.

11) Indemnification

You agree to indemnify and hold harmless Camp Trask, the Council, and staff from any claims, liabilities, damages, losses, and expenses (including attorneys' fees) arising from your Content, your use of the Service, or your violation of these Terms or applicable law.

12) Service Changes and Availability

We may update, suspend, or discontinue the Service at any time without liability. Features may change, and we do not guarantee continuous availability.

13) Arbitration and Class Action Waiver

Any dispute arising under these Terms will be resolved by binding arbitration in Los Angeles County, California, under the rules of the American Arbitration Association. You waive the right to bring claims in court or participate in a class action. Nothing in this section prevents either party from seeking injunctive relief in court for misuse of intellectual property.

14) Governing Law

These Terms are governed by the laws of California, United States, without regard to conflict of laws principles. Venue for any permitted court proceedings lies exclusively in Los Angeles County, California.
